Welcome to BogeyBuds. These Terms of Service ("Terms") govern your access to and use of the BogeyBuds mobile application ("the App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

BogeyBuds is a social platform designed to connect golfers. The App provides the following features:

• Discover and connect with nearby golfers
• Direct messaging and group chat
• Golf course discovery with interactive maps
• Scorecard tracking and round history
• Clubhouse social feed with posts and comments
• Tee time scheduling and invitations
• Weather forecasts for golf courses

3. User Accounts

To use the App, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this age requirement.

4. User Content

You retain ownership of content you post through the App, including posts, photos, comments, and messages ("User Content"). By posting User Content, you grant BogeyBuds a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App.

You are solely responsible for your User Content and represent that:

• You own or have the necessary rights to post the content
• Your content does not violate any third party's rights
• Your content complies with these Terms and applicable laws

5. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Harass, bully, threaten, or intimidate other users
• Post content that is hateful, discriminatory, defamatory, or obscene
• Impersonate any person or entity
• Spam or send unsolicited messages to other users
• Attempt to gain unauthorized access to other users' accounts
• Upload malicious software or code
• Interfere with or disrupt the App's infrastructure
• Scrape, crawl, or collect data from the App without authorization
• Use the App for commercial solicitation without our prior consent

6. Intellectual Property

The App, including its design, features, code, graphics, and branding, is owned by BogeyBuds and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

The BogeyBuds name, logo, and all related marks are trademarks of BogeyBuds. You may not use these marks without our prior written permission.

7. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any defects in the App will be corrected
• Weather data, course information, or other third-party data is accurate

We are not responsible for the conduct of any user, whether online or offline. You use the App and interact with other users at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BogeyBuds and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or related to your use of the App.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may also update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
